What are your choices?

If you are eligible to participate in the settlement of this case, you have four options:

  1. You can submit a claim to participate in the settlement. If the Court approves the settlement, and your eligibility is confirmed, you will receive a payment from the settlement fund in accordance with the allocation plan in the settlement agreement, which is described here (item #2). To submit a claim, click the submit claim button below. Claims must be received by March 1, 2024.

  2. You can object to this settlement. The settlement is subject to approval by the Court, which will consider the fairness of the settlement for the members of the class. If you believe the settlement is not fair, or have any other reason for objecting to it, then you may submit your objection by filing an objection with the Court by following the procedures described here (item #6). If the Court approves the settlement, and you do not submit a claim or opt out of this case, your claims will be dismissed. Objections must be received by December 4, 2023.

  3. You can opt-out of this lawsuit. That means you will not participate in this settlement but may have the right to bring your own lawsuit or arbitration against the Defendants using your own attorney. You must opt-out if you are a class member in the Watkins lawsuit in Nevada and want to pursue your claims against Defendants in that case, otherwise your claims in that case will be released. To submit an opt out request, click the opt out button below. Opt-out requests must be received by December 4, 2023.

  4. You can do nothing. If you choose to make no response, then you will not participate in the settlement. Even though you will not receive any money, your claims against Defendants will be dismissed and you will not have the right to pursue those claims against Defendants in the future. If you are a class member in the Watkins lawsuit in Nevada and make no response, your claims in that case will also be released.
